Welcome to Collecto.rs ("Collecto.rs," "we," "us," or "our"). These Terms of Use ("Terms") govern your access to and use of the Collecto.rs mobile and web application ("App"), including any content, functionality, and services offered through the App.

By accessing or using Collecto.rs, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the App.

1. Eligibility

You must be at least 13 years old (or 16 years old in the European Union) to use Collecto.rs. By using the App, you represent and warrant that you meet this eligibility requirement.

2. User Accounts

To access certain features of Collecto.rs, you must create an account by providing your name and email address. You agree to provide accurate, current, and complete information and to update your information as necessary. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3. User Content and Data Rights

3.1 Ownership and License

You retain ownership of any images, content, or data ("User Content") you upload to Collecto.rs. However, by uploading User Content, you grant Collecto.rs a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to use, reproduce, distribute, display, modify, adapt, and create derivative works from your User Content for the purposes of operating, promoting, and improving the App and our services.

3.2 Responsibility for User Content

You represent and warrant that you have all necessary rights to upload and share your User Content and that your User Content does not infringe upon the intellectual property rights, privacy rights, or other rights of any third party.

3.3 Right to Remove Content

Collecto.rs reserves the right, but is not obligated, to remove or disable access to any User Content at any time and for any reason, including if we believe the content violates these Terms or applicable laws.

4. Monetization and Affiliate Links

Collecto.rs reserves the right to monetize interactions within the App. Specifically, Collecto.rs may append affiliate links to items listed for sale or linked to external purchase pages. By using the App, you acknowledge and agree that Collecto.rs may earn commissions or other compensation from affiliate links or other monetization methods.

5. Prohibited Conduct

You agree not to:

• Use Collecto.rs for any unlawful or unauthorized purpose.
• Upload or share content that is illegal, harmful, threatening, abusive, defamatory, obscene, invasive of privacy, or otherwise objectionable.
• Attempt to interfere with or disrupt the operation of Collecto.rs or its servers.
• Attempt to gain unauthorized access to other users' accounts or data.

6. Indemnification

You agree to indemnify, defend, and hold harmless Collecto.rs, its affiliates, officers, directors, employees, agents, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

• Your violation of these Terms.
• Your use of Collecto.rs, including your User Content.
• Any data loss, corruption, or transformation of your User Content or other data uploaded or stored on Collecto.rs.

7. Disclaimer of Warranties

Collecto.rs is provided "as is" and "as available," without warranties of any kind, either express or implied. Collecto.rs does not warrant that the App will be uninterrupted, error-free, secure, or free from viruses or other harmful components. You use Collecto.rs at your own risk.

8. Limitation of Liability

To the fullest extent permitted by applicable law, Collecto.rs, its affiliates, officers, directors, employees, agents, licensors, and service providers shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use or inability to use Collecto.rs, including but not limited to data loss, data corruption, or data transformation, even if Collecto.rs has been advised of the possibility of such damages.

9. Changes to Terms

Collecto.rs reserves the right to modify these Terms at any time. We will notify you of significant changes by posting the updated Terms on the App and updating the "Effective Date" at the top of these Terms. Your continued use of Collecto.rs after such changes constitutes your acceptance of the revised Terms.

10. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the state of California, United States, without regard to its conflict of law principles. Any disputes arising from these Terms or your use of Collecto.rs shall be resolved exclusively in the courts located in Los Angeles, CA, USA.

11. Termination

Collecto.rs reserves the right to terminate or suspend your account and access to the App at any time, without notice, for any reason, including violation of these Terms.
